SCOTLAND Yard is facing a possible six-figure compensation claim over failure to prevent the killing of Rachel Nickell in 1992. Andre Hanscombe, whose son by Miss Nickell was two when he witnessed her murder on Wimbledon Common, plans to sue the Met for negligence for hundreds of thousands of pounds. Mr Hanscombe, 46, who also wants a public inquiry, claims Miss Nickell would still be alive if police had caught her killer, paranoid schizophrenic Robert Napper, when they had the chance three years earlier. Miss Nickell was 23 when she was stabbed 49 times and sexually assaulted in front of her son Alex. Details of the planned legal action were revealed in letters to some of Nappers surviving victims, according to the Daily Mail. Napper admitted Miss Nickells manslaughter last December and is to be held indefinitely at Broadmoor psychiatric hospital. It later emerged police failed to identify him as a rapist responsible for up to 106 attacks. He was caught after he killed Samantha Bisset, 27, and her daughter Jazmine, 4, in 1993. Scotland Yard said today it had no knowledge of the legal claim. A TYCOON today pleaded with a High Court judge he should be spared jail because he has mental health problems. But Scot Youngs estranged wife insisted he should hear the clang of the prison gates behind him. Lawyers representing Michelle Young, 45, told the court she believes he could be feigning his symptoms and pulling the wool over doctors eyes. Young, 47, who has been described as a fixer for Russian oligarchs and British billionaires, claims he is penniless but his wife, who is suing for divorce and main- tenance, has put his wealth at 400m. She claims she faces eviction from her Regents Park home because her hus- band has failed to pay the 10,000-a- month rent -- even though she suspects he owns the property himself. He has also failed to pay the 36,000 annual private school fees for their children Scarlet, 16, and Sasha, 14, the court heard. In June Mrs Justice Parker ordered Young to come clean about his finances -- or face six months in prison. Today Youngs lawyers admitted he was in default of the court order but stressed he apologised, having now realised his failings and promised to comply in future. He has said his property empire has collapsed and he is being pursued for 27 m by creditors. He expects to be made bankrupt and says that far from h a v i n g 4 0 0 m h e i s w o r t h minus-27 m. He says he can only afford legal rep- resentation thanks to a 50,000 loan from his friend, restaurateur Richard Caring. Young is also said to be a close friend of billionaire entrepreneur Sir Tom Hunter and Sir Philip Green. Since August he has been treated by a psy- chiatrist and undergone hospital treat- ment. But David Balcombe QC, representing Mrs Young, said all the husbands expressions of contrition are cynically contrived. He went on: He is somebody who has enjoyed a massive fortune but now says its all gone, but hasnt provided any worthwhile information to enable his wife to understand where it has all gone and how it has all gone. Mr Balcombe complained there was a paucity of information about Mr Youngs mental health problems and called for an independent doctor to examine him. The judge is expected to make her decision on whether to jail Young or not later today but she renewed the order that his passport should continue to be held by the court. The case continues.
